Official Statement with regards to Infinity Land
We refer to the recent newspaper reports with regards to the decision of the Federal Court in Tan Ying Hong v Tan Sian San & Ors. We understand that there are concerns by various parties on how this decision may affect the ownership of our land in Tanjung Bungah on which the Infinity Condominium project now resides. Infinity is developed/managed by Diamaward (M) Sdn. Bhd. and Hunza Properties (North) Sdn. Bhd., both wholly-owned subsidiaries of Hunza Properties Berhad
Essentially, Diamaward (M) Sdn. Bhd. has indefeasible title to the said Lands and it shall correspondingly have full and unimpeachable legal powers , capacity and authority to transfer and give good registrable and indefeasible strata title(s) for the condominium units in the Infinity Project to the respective purchasers thereof.
Enclosed below is the legal opinion from our solicitor with regards to the status of Infinity Land. It also sets out the background of the legal cases. We hope the legal opinion clarifies doubts, if any, which you may have over this issue.
